Terms and Conditions

These terms and conditions ("Terms") explain the basis on which we provide our booking assistance service and related digital services to you via bookmytheorytest.com. Please read them carefully before placing an order.
By placing an order on our website you agree to be bound by these Terms. If you do not agree, you must not use our services.
1. Who we are and how to contact us
1.1 In these Terms, "we", "us" and "our" refer to BookMyTheoryTest, operated by DJM Group LTD, the provider of the services described below.
1.2 You can contact us by email at contact@bookmytheorytest.com. For escalations you can email help@bookmytheorytest.com.
1.3 If we need to contact you we will normally do so by email using the address you provided when placing your order. We may also contact you by phone or SMS if you have provided those details.
1.4 When we use the words "writing" or "written" in these Terms, this includes email.
1.5 Important – independence from DVSA. We are an independent booking assistance service. We are not the DVSA, we are not GOV.UK, and we are not endorsed by any government department. You can book an official DVSA theory test yourself directly at GOV.UK for £23 (correct at the time of writing): www.gov.uk/book-theory-test.
2. Our services
2.1 We provide an online service that helps you apply for and manage a Great Britain theory test (car, motorcycle, LGV or PCV) with the Driver and Vehicle Standards Agency (DVSA). Our service may include:
- collecting your application details via an online form;
- submitting a booking request to DVSA on your behalf;
- sending booking confirmation details to you by email; and
- where purchased, providing additional services such as Pass Protection and/or access or links to learning resources.
2.2 When you place an order with us you authorise us to act as your agent to arrange and manage a DVSA theory test booking using the information you provide.
2.3 Our prices are made up of:
- the official DVSA theory test fee (for most car tests this is £23 in Great Britain, but this can change at DVSA's discretion); and
- our service fee for handling your booking and, where included, additional products such as Pass Protection.
2.4 Sometimes we show a single combined price. Where we do, this combined price may include both:
- the DVSA test fee; and
- our service fee.
What is included with each package is clearly shown before you pay and again in your confirmation email.
2.5 Access to our website, your account area and any mock tests or learning resources we provide is a digital service, which begins as soon as your payment is completed.
3. Placing an order and when the contract is formed
3.1 Our acceptance of your order takes place when your payment is successfully processed and you see an on-screen confirmation page and/or receive a confirmation email from us. At that point, a contract is formed between you and us for the services you have purchased.
3.2 You must be at least 18 to enter into a contract with us. If the person taking the theory test is under 18, the booking must be made by a parent or legal guardian (or under their permission and supervision).
3.3 We may be unable to accept your order, for example if:
- your chosen test centre, date or time is no longer available;
- DVSA does not accept the booking; or
- the details you provide are incomplete or obviously invalid.
If that happens we will let you know as soon as reasonably possible and will either offer you a suitable alternative or cancel your order and refund any DVSA test fee we have not already used.
3.4 You are responsible for making sure all information you give us is correct, including:
- your name and address;
- your date of birth;
- your email address and phone number;
- your GB driving licence number;
- your preferred test type, centre and date; and
- any accessibility/support requirements.
We are not responsible for problems, additional costs or test issues arising from incorrect or incomplete information you supply.
3.5 We will allocate a booking or order reference and include this in your confirmation email. Please quote this reference when you contact us about your booking.
4. Pass Protection and mock tests (where included in your package)
4.1 Some packages include Pass Protection or a similar resit guarantee. Full details, including eligibility criteria, are set out on our Pass Protection Guarantee page at the time you buy.
4.2 In general, where Pass Protection is included:
- if you attend your DVSA theory test and fail, you may be eligible for one paid resit arranged by us; and
- you must meet all eligibility rules set out on the Pass Protection page (for example, completing any required mock tests and achieving at least the minimum score before your DVSA test date).
4.3 You will normally not be eligible for a Pass Protection resit if:
- you do not attend your DVSA test or arrive too late to be admitted;
- your test is cancelled because you did not bring the correct ID or documents;
- you change or cancel the DVSA booking directly with DVSA; or
- you do not meet the Pass Protection conditions set out at the time of purchase (for example, you do not complete the required mock tests, or you do not achieve the minimum score).
4.4 Any mock tests we provide are for practice only. They are not official DVSA examinations. Where we link to official DVSA digital learning materials, those are provided by or on behalf of DVSA under their own terms and licences.
5. Changes to your booking
5.1 If you wish to change the date, time or centre of your theory test, please contact us as soon as possible using the details in section 1.
5.2 DVSA rules require three full working days' notice (Monday to Saturday, excluding Sundays and public holidays) to amend or cancel a booking without losing the DVSA test fee. If you come to us with less notice than this, it may not be possible to change or cancel your test without losing the DVSA fee.
5.3 We will use reasonable efforts to process change requests, but all changes are subject to DVSA rules and test centre availability. We cannot guarantee that your preferred alternative date, time or centre will be available.
5.4 If you change your theory test date, any time limits for completing mock tests or complying with Pass Protection conditions (where applicable) will still apply as described on the Pass Protection page or in your confirmation email.
6. Cancellations and refunds
6.1 Our booking assistance service and any digital services (such as access to your account, mock tests or learning resources) begin immediately after your payment is completed. Because of this, our service fee is non-refundable once your order is confirmed, except where we are at fault or are required to refund you by law.
6.2 The DVSA test fee portion of your payment may be refundable if you give us enough notice to cancel or amend your DVSA booking in line with DVSA rules. In general, DVSA requires at least three full working days before the test date for a refund or free amendment.
6.3 If:
- you ask us to cancel or amend with sufficient notice and DVSA allows the change or refund, we will either refund you the DVSA fee we recover, or (if you ask) apply it to a new booking; but
- you do not give enough notice, or DVSA does not allow the change or refund, you may lose part or all of the DVSA test fee.
6.4 If your test is due to take place in fewer than three full working days, you can still ask us to cancel, but it is unlikely that you will receive a refund of the DVSA test fee, and your booking may not be amendable.
6.5 To cancel your booking with us you must contact us in writing (usually by email) using the details in section 1 and include your name, email and booking reference.
7. Price and payment
7.1 The price you pay is shown clearly on the checkout page before you place your order. Prices are in pounds sterling (GBP) and include VAT where applicable.
7.2 We accept payment by major debit and credit cards and any other methods offered via our payment provider (such as Apple Pay or Google Pay). You must pay in full at the time of booking. We cannot confirm or maintain a booking if payment is declined or reversed.
7.3 We may update our prices at any time. Price changes will not affect orders that have already been placed and confirmed.
8. Attending your DVSA theory test
8.1 It is your responsibility to attend the DVSA test centre at the correct date and time and to bring all required identification and documents, such as a valid GB or NI photocard driving licence, in line with DVSA rules.
8.2 DVSA may cancel or refuse your test if you arrive late, do not bring the required ID, or do not meet their eligibility criteria. In these circumstances you may lose your DVSA test fee and any Pass Protection eligibility, and we are not responsible for any losses you incur.
8.3 If your test is delayed or cancelled by DVSA or by events outside our control (for example, test centre closure, severe weather, strikes or IT failures), we will work with you to rearrange your booking where possible. However we are not responsible for any additional costs you incur (such as travel, accommodation, time off work or re-booking fees).
9. Using our website and content
9.1 You may use our website and services only for your own personal, non-commercial use in connection with booking and preparing for a DVSA theory test.
9.2 You must not:
- copy, reproduce, modify, distribute, sell or rent any part of our website or services;
- attempt to reverse engineer, decompile or otherwise obtain the source code of any part of our platform, except where permitted by law;
- use our services to build or support a competing service or to provide services to third parties;
- share your account or access details with anyone else or allow others to use your booking; or
- attempt to gain unauthorised access to our systems or circumvent security or payment controls.
10. Our responsibility for loss or damage suffered by you
10.1 We are responsible to you for loss or damage you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill.
10.2 We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the services.
10.3 We only provide our services for personal, domestic use. If you use our services for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
10.4 We are not responsible for:
- decisions made by DVSA or test centres, including cancellations, refusals or failures;
- delays, interruptions or issues caused by the internet or other communication networks;
- loss or damage that you could have avoided by following our reasonable instructions; or
- losses caused by you providing incorrect or incomplete information.
11. How we use your personal information
11.1 We will only use your personal information as set out in our Privacy & Cookies Policy.
11.2 We share some of your information (for example your name, contact details and driving licence number) with DVSA only for arranging and managing your theory test booking, or as otherwise required by law.
12. Other important terms
12.1 We may transfer our rights and obligations under these Terms to another organisation. We will notify you if this happens and will ensure that the transfer does not reduce your legal rights.
12.2 You may only transfer your rights or obligations under these Terms to another person if we agree to this in writing.
12.3 This contract is between you and us. No other person shall have any rights to enforce any of its terms.
12.4 Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
12.5 If we do not insist immediately that you do something you are required to do under these Terms, or we delay in taking steps against you in respect of your breaking this contract, that does not mean you do not have to do those things and it does not prevent us taking steps against you at a later date.
12.6 Occasionally, cancelling or changing a booking on the DVSA platform may affect other bookings you hold under the same DVSA account or driving licence number. We are not responsible for the DVSA system design or for the consequences of changes you make directly on the DVSA website.
12.7 These Terms are governed by the laws of England and Wales. You can bring legal proceedings in connection with the services in the courts of England and Wales. If you live in Scotland, you may also bring proceedings in the Scottish courts. If you live in Northern Ireland, you may also bring proceedings in the courts of Northern Ireland.
